Can I skip probate?
Check the estate against your state's small-estate affidavit cap for the date of death and see the earliest date you can use it.
Choose the state to see its cap, waiting period and rules.
How the checker works
- The cap is the one in force on the date of death; states that changed their cap keep the older amount for earlier deaths. If we have no verified cap for that date, the tool says so instead of guessing.
- The earliest date adds the state's waiting period to the date of death.
- Enter only what the person owned in their own name with no beneficiary or co-owner; the state page lists what counts and what is left out.
- Nothing you type is sent anywhere. The tool runs in your browser.
