DE 1000M: Appeal Form

DE 1000M is the Appeal Form for disagreeing with an EDD decision, such as a denial or an overpayment notice. The appeal goes to the California Unemployment Insurance Appeals Board. A signed letter also works if you do not have the form.

Last checked: · Form revision: DE 1000M Rev. 9 (3-26)

Who uses it
Claimants or employers who disagree with an EDD Notice of Determination, Ruling or similar notice, including overpayment notices.
When you get or need it
It comes with the Notice of Determination or Notice of Overpayment, or you can download it from EDD's Forms page (fill-in forms). A Spanish version is on the back.
How to submit it
Sign it and return it to EDD at the office address on the notice you are appealing (top of the Notice of Determination). If you do not have the form, write a letter with your name, address, phone, Social Security number, the decision you are appealing and your reasons. Phone for the address: 1-800-300-5616.
Deadline
30 days from the mail date of the notice (the Appeals Board says postmarked within 30 calendar days). After that you must state the reason for the delay and the judge decides whether you had good cause. The form gives claimants of Disaster Unemployment Assistance 60 days.

What each part means

Labels are quoted from the form; the explanation is EDD's own meaning in plain words, not advice on how to answer.

Certification notice (top of the form)
While the appeal is pending you must continue to certify. If you are found eligible you can be paid only for weeks you certified and met all other requirements.
Section I: Appellant Information
Your name, Social Security number, whether you need a translator and which language, mailing address, phone, fax, email and cell number, and consent boxes for the Appeals Board to email or text confidential case information.
Employer appeals only
Employer account number and agent name and address, if applicable.
Section II: Appellant Statement
Finish the sentence “I disagree with the determination in the notice dated … because …” and explain why. Attach extra pages with your name and Social Security number on each.
Signature and Date
The appellant or agent must sign and date the form, using black ink.

What EDD warns about

  • Count the 30 days from the mail date printed on the notice, not from the day you opened it.
