DE 1080CZ: Notice of Determination

DE 1080CZ is EDD's written decision on your eligibility. The notice explains the facts and the law EDD relied on and ends with your appeal rights. EDD's forms list calls it a Notice of Determination and/or Ruling.

Last checked: · Form revision: DE 1080CZ Rev. 2 (8-21)

Who uses it
Claimants (and in some cases employers) who receive an eligibility decision. The sample is a denial or reduced-benefit notice.
When you get or need it
Mailed after EDD decides an eligibility issue, for example after an eligibility interview or when you reported earnings or statements EDD questions. It comes with an Appeal Form (DE 1000M).
How to submit it
Nothing to submit. To appeal, send the enclosed DE 1000M (or a letter with your Social Security number and your reasons) to the office address printed at the top of the notice.
Deadline
Appeal within 30 days of the mail date; the notice prints a “no later than” date. A late appeal must explain the delay, and an administrative law judge decides whether you had good cause.

What each part means

Labels are quoted from the form; the explanation is EDD's own meaning in plain words, not advice on how to answer.

Header: Notice of Determination, Date Mailed, Benefit Year Began
The issuing office address, the date mailed (which starts your appeal clock), your name and address, and EDD phone numbers by language.
Ineligibility statement
States that you are not eligible under a specific Unemployment Insurance Code section for a listed date range.
Findings and law cited
Explains the earnings or facts EDD relied on and quotes the code sections, for example 1279 (earnings), 1252 (unemployed week), 1257A (false statement) and 1260D (penalty weeks).
APPEAL
You may appeal all or part of the decision. Complete DE 1000M or write a letter with your Social Security number on every page, mail it to the office address on page 1, and file within 30 days of the mail date.
APPEAL INFORMATION
After you appeal, EDD reviews the decision. If it is unchanged, EDD sends the case to the Office of Appeals, and a hearing notice with the date, place and time follows.
CONTINUING CERTIFICATION
If you are eligible to continue, EDD issues continued claim forms and you must certify on time. In some cases you cannot certify until the judge decides. You are paid only for weeks you certified and were otherwise eligible.

What EDD warns about

  • The sample on EDD's site covers only wage-reduction and false-statement denials. Your own notice may cite different code sections; read what yours says.
