When can a rent increase start in Idaho?
Choose the state and the date the notice is given.
How much notice is required
For all residential leases, the landlord must give written notice of any rent increase at least 30 days before the increase takes effect. The same 30 days' written notice applies to a landlord's non-renewal of a lease. (Idaho Code § 55-304(2))
| Applies to | When | Notice |
|---|---|---|
| Any tenancy | — | 30 days |
- The notice must be in writing.
Example: a notice handed over on November 2, 2026 in Idaho
Earliest date the new rent can start, with rent due on the 1st, worked out from the Idaho rule above:
- For a month-to-month tenant of 1 year raising rent 5% or a month-to-month tenant of 3 years raising rent 12% or a week-to-week tenant raising rent 5%: Wednesday, December 2, 2026
Raising rent during a lease
If the lease sets the rent for a set period (like six months or a year), the landlord cannot raise it during that time. (Idaho Legal Aid Services, Advice for Idaho Renters (2025))
City and county rent control
Local governments may not enact, keep or enforce any ordinance that would regulate rent, fees or deposits for private residential leases. (Idaho Code § 55-306)
Retaliatory rent increases
No Idaho statute specifically bars retaliatory rent increases for ordinary rentals. The Attorney General's manual says landlords may not evict a tenant for requesting repairs or joining a tenants' association. (Idaho AG Landlord and Tenant Manual (July 2026))
Also good to know
- The AG manual says the 30-day written notice also covers increases in fees, fines, assessments, interest or other costs.
- Section numbers changed in 2025 (H 2025 c. 65): the notice rule formerly at § 55-307 is now § 55-304; § 55-307 now covers removal of fixtures.
- Manufactured home parks: 90 days' written notice for most rent increases (AG manual; Idaho Code ch. 55-20).
