When can a rent increase start in Indiana?

Choose the state and the date the notice is given.

How much notice is required

Indiana has no rent-increase notice statute. A landlord changes the rent by giving the notice needed to end the tenancy: one month's written notice for a tenancy at will, or notice equal to the rent period for a periodic tenancy of 3 months or less. Notice may be served on the tenant, on a resident of the home, or posted on the premises. (IC 32-31-1-1, 32-31-1-4, 32-31-1-9)

No separate rent-increase rule: the periods below are the notice to end a periodic tenancy.

Applies toWhenNotice
Month-to-month—1 month
Week-to-week—7 days
  • The notice must be in writing.

Example: a notice handed over on November 2, 2026 in Indiana

Earliest date the new rent can start, with rent due on the 1st, worked out from the Indiana rule above:

  • For a month-to-month tenant of 1 year raising rent 5% or a month-to-month tenant of 3 years raising rent 12%: Wednesday, December 2, 2026
  • For a week-to-week tenant raising rent 5%: Monday, November 9, 2026

Raising rent during a lease

No Indiana statute directly addresses raising rent during a fixed-term lease; the retaliation chapter refers to increases during the term only 'if provided for in the rental agreement.' (IC 32-31-8.5-5(b)(2))

City and county rent control

A city, town or county may not regulate rental rates for private property unless the General Assembly authorizes it, and may not regulate lease terms, fees or disclosures. Government-funded reduced-rent housing is excluded. (IC 32-31-1-20)

Retaliatory rent increases

A landlord may not raise rent in response to a tenant's protected activity (code complaint, written complaint about IC 32-31-5-6 or 32-31-8-5 duties, suing the landlord, joining a tenant group, testifying). The landlord may still raise rent to comparable market rent at the end of the term, or during it if the lease allows. No presumption period. (IC 32-31-8.5-2, -4, -5)

Also good to know

  • Local units may not regulate retaliatory acts (IC 32-31-8.5-6).
  • Year-to-year tenancy: notice at least 3 months before the year ends (IC 32-31-1-3).
