Ending a month-to-month tenancy
If you are the tenant
- Tenant or landlord: Either party may end a month-to-month tenancy by written notice given at least 30 days before the periodic rental date specified in the notice (Iowa Code 562A.34(2)).
Written notice required: Yes. Termination notices must be written (Iowa Code 562A.34) and served by an allowed method, e.g., hand delivery, signed acknowledgment, or regular plus certified mail (Iowa Code 562A.8).
Week-to-week and other periodic tenancies
- week-to-week, both: 10 days. Either party may end a week-to-week tenancy by written notice given at least 10 days before the termination date specified in the notice (Iowa Code 562A.34(1)).
Leaving a fixed-term lease early
If the tenant abandons the unit, the landlord must make reasonable efforts to re-rent at a fair rental; the lease ends when a new tenancy begins. If the landlord fails to try or accepts the abandonment as a surrender, the lease is deemed ended when the landlord learns of the abandonment (Iowa Code 562A.29(3)).
Landlord's duty to re-rent: Yes. If the tenant abandons the dwelling unit, the landlord shall make reasonable efforts to rent it at a fair rental (Iowa Code 562A.29(3)).
Lease-break fees: No statutory limit; the lease controls (subject to mitigation).
When Iowa law lets you leave early
Military service (state law) (Iowa Code 29A.101A)
An Iowa National Guard member on full-time Guard duty or state active duty for 30+ consecutive days may end a residential lease signed before entering that service (or before PCS/90+ day deployment orders); with monthly rent, termination is effective 30 days after the next rent due date after notice.
- Proof:
- Written notice plus a copy of the military orders.
- What you still owe:
- Rent prorated to the effective date; prepaid rent after that refunded within 30 days.
Unit unlivable or landlord fails to repair (Iowa Code 562A.21)
If the landlord materially fails to comply with the lease or maintain fit premises (562A.15) and does not remedy it within 7 days of written notice, the lease ends on the date in the notice.
- Notice:
- 7 days, in writing
- Proof:
- Written notice specifying the landlord's breach and a termination date at least 7 days after receipt.
- What you still owe:
- Landlord returns prepaid rent and recoverable deposit.
Unit unlivable or landlord fails to repair (Iowa Code 562A.25)
If fire or casualty substantially impairs enjoyment of the unit, the tenant may move out immediately and end the lease.
- Notice:
- 14 days, in writing
- Proof:
- Written notice of intent to terminate within 14 days after vacating.
- What you still owe:
- Lease ends on the date of vacating; rent accounted as of the date of the casualty.
Landlord harassment or illegal entry (Iowa Code 562A.26)
If the landlord unlawfully removes or excludes the tenant, or willfully cuts off electric, gas, water or another essential service, the tenant may end the rental agreement (or recover possession).
- Proof:
- None stated.
- What you still owe:
- Landlord must return all prepaid rent and the security deposit; tenant may recover actual damages, punitive damages up to twice the monthly rent, and reasonable attorney fees.
Military orders, every state: the federal SCRA lets servicemembers with orders (permanent change of station or deployment of 90+ days) end a lease with written notice and a copy of the orders. How the SCRA date is counted.
