When can I move out in Wyoming?

Choose your state, your situation and the date your landlord will receive notice.

Ending a month-to-month tenancy

If you are the tenant

  • No Wyoming statute sets how much notice a tenant must give to end a month-to-month tenancy, and no official source stating a default rule was found; the rental agreement controls.

If the landlord ends it

  • No Wyoming statute sets a no-cause notice period for a landlord to end a month-to-month tenancy, and no official source stating a default rule was found. Before filing an eviction against a tenant holding over, the landlord must serve a 3-day notice to quit (Wyo. Stat. §§ 1-21-1002, 1-21-1003).

Written notice required: Not stated. No statute addresses the form of a tenant's notice to end a periodic tenancy. A landlord's notice to quit must be a written copy (§ 1-21-1003); a domestic-violence vacating notice must be written (§ 1-21-1303).

Leaving a fixed-term lease early

No statute addresses a tenant leaving a fixed-term lease early; the lease controls. Domestic-violence victims have an affirmative defense to rent after vacating (§ 1-21-1303).

Landlord's duty to re-rent: Unsettled. No Wyoming statute requires mitigation. Goodwin v. Upper Crust of Wyoming, Inc., 624 P.2d 1192 (Wyo. 1981), was a commercial sublease case: the lessor conceded a duty to mitigate and the court held the tenant must produce evidence that the landlord failed to mitigate. No official source settles the rule for residential leases.

Lease-break fees: No statutory limit; the lease controls. Safe Homes Act rights cannot be waived or modified by the lease (§ 1-21-1304).

When Wyoming law lets you leave early

  • Domestic violence, sexual assault or stalking (Wyo. Stat. § 1-21-1303)

A tenant facing a credible imminent threat of domestic abuse or sexual violence, or who was a victim on the premises, who gives 7 days' written notice before moving out has a defense to rent after leaving. This cannot be waived in a lease.

    Notice:
    7 days, in writing
    Proof:
Medical, court or police evidence of domestic abuse or sexual violence (including stalking); for abuse on the premises, it must have occurred within 60 days before notice (or as soon as practicable).
    What you still owe:
Affirmative defense: not liable for rent for the period after vacating; still owes rent up to vacating and giving notice.
  • Military service (state law) (Wyo. Stat. § 19-11-122(a))

Wyoming National Guard members ordered to active state service for over 30 consecutive days get all federal SCRA protections, including lease termination.

    Proof:
Orders to active state service for more than 30 consecutive days.
    What you still owe:
Same as federal SCRA lease termination.
  • Unit unlivable or landlord fails to repair (Wyo. Stat. §§ 1-21-1203, 1-21-1206)

If the landlord fails to fix unsafe or unsanitary conditions after required notices, the tenant may sue and the court may declare the rental agreement terminated (tenant cannot terminate unilaterally under the statute).

    Proof:
Tenant current on rent gave written notice of the condition and a 'notice to repair or correct condition' (certified mail or per § 1-21-1003), and the landlord failed to correct it; then a court action.
    What you still owe:
Court may terminate the agreement; tenant gets the rent balance and deposit back within 30 days and must vacate 10–20 days after the court's termination.

Military orders, every state: the federal SCRA lets servicemembers with orders (permanent change of station or deployment of 90+ days) end a lease with written notice and a copy of the orders. How the SCRA date is counted.

Also good to know

  • If the landlord refuses to make costly repairs, the landlord may end the agreement with 10 to 20 days' written notice; rent is prorated to move-out and the deposit refunded (§ 1-21-1203(d)).
  • Holdover or nonpayment: the landlord must serve a written notice to quit at least 3 days before filing forcible entry and detainer (§ 1-21-1003; Wyoming Judicial Branch FED Form 00).
