When can I move out in Kansas?

Ending a month-to-month tenancy
If you are the tenant
- Tenant or landlord: Either party may end a month-to-month tenancy by written notice stating that the tenancy ends on a periodic rent-paying date at least 30 days after the notice is received (K.S.A. 58-2570(b)).
Written notice required: Yes. Termination notices must be written (K.S.A. 58-2570). If a landlord supplies a move-out form that adds terms not in the lease, it must carry a bold warning or those terms do not bind the tenant (K.S.A. 58-2570(e)).
Week-to-week and other periodic tenancies
- week-to-week, both: 7 days. Either party may end a week-to-week tenancy by written notice at least 7 days before the termination date specified in the notice (K.S.A. 58-2570(a)).
Leaving a fixed-term lease early
If the tenant abandons the unit, the landlord must make reasonable efforts to re-rent at a fair rental; the lease ends when a new tenancy begins, or when the landlord learns of the abandonment if it fails to try or accepts the surrender (K.S.A. 58-2565(c)).
Landlord's duty to re-rent: Yes. If the tenant abandons the dwelling unit, the landlord shall make reasonable efforts to rent it at a fair rental (K.S.A. 58-2565(c)).
Lease-break fees: No general statutory limit; the lease controls (subject to mitigation). For domestic violence terminations, a termination fee may not exceed one month's rent and must be in the lease (K.S.A. 58-25,137(e)).
When Kansas law lets you leave early
Domestic violence, sexual assault or stalking (K.S.A. 58-25,137)
A tenant who in the last 12 months was, or is in imminent danger of becoming, a victim of domestic violence, sexual assault, human trafficking, or stalking is not liable for rent after vacating once they notify the landlord.
- Proof:
- A statement to the landlord; if asked, either a court order or a document signed by the victim and a licensed physician, physician assistant, nurse, or behavioral-sciences professional declaring under penalty of perjury that the abuse occurred.
- What you still owe:
- Not liable for rent after moving out; still owes rent and other amounts for the period before. The landlord may charge a termination fee of up to one month's rent only if the lease provides for it.
Military service (state law) (K.S.A. 58-2570(b))
A month-to-month tenant in U.S. military service whose move is required by military orders needs to give no more than 15 days' written notice.
- Notice:
- 15 days, in writing
- Proof:
- Military orders requiring the move.
- What you still owe:
- Not stated beyond the shortened notice.
Unit unlivable or landlord fails to repair (K.S.A. 58-2559)
If the landlord materially fails to comply with the lease or with health-and-safety maintenance duties and does not start a good-faith fix within 14 days, the lease ends on the date in the notice.
- Notice:
- 30 days, in writing
- Proof:
- Written notice describing the breach and stating the lease ends on a rent-paying date at least 30 days after receipt.
- What you still owe:
- Landlord returns the recoverable security deposit.
Unit unlivable or landlord fails to repair (K.S.A. 58-2562)
If fire or casualty substantially impairs use and habitability, the tenant may move out immediately and end the lease.
- Notice:
- 5 days, in writing
- Proof:
- Written notice of intent to terminate within 5 days after vacating.
- What you still owe:
- Lease ends on the date of vacating; rent accounted as of that date.
Military orders, every state: the federal SCRA lets servicemembers with orders (permanent change of station or deployment of 90+ days) end a lease with written notice and a copy of the orders. How the SCRA date is counted.
Also good to know
- A lease for a definite term longer than 30 days is not a month-to-month tenancy even if rent is paid monthly (K.S.A. 58-2570(b)).
- A willful holdover can cost up to 1.5 months' rent or 1.5 times actual damages (K.S.A. 58-2570(c)).
