When can I move out in Oklahoma?
Choose your state, your situation and the date your landlord will receive notice.
Ending a month-to-month tenancy
If you are the tenant
- A tenant may end a month-to-month tenancy (or tenancy at will) with written notice served at least 30 days before the date the termination is to take effect. The 30 days run from the date the notice is served (41 O.S. § 111(A)).
If the landlord ends it
- A landlord may end a month-to-month tenancy (or tenancy at will) with written notice served at least 30 days before the date the termination is to take effect. No reason is required by statute (41 O.S. § 111(A)).
Written notice required: Yes. Notice must be in writing and served personally; if the tenant cannot be found it may be given to a family member over 12 or posted and mailed by certified mail; notice to a landlord who cannot be served personally goes by certified mail (41 O.S. § 111(A), (E)).
Week-to-week and other periodic tenancies
- week-to-week, both: 7 days. When the tenancy is shorter than month-to-month, either party may end it with written notice served at least 7 days before the date the termination is to take effect (41 O.S. § 111(B)).
Leaving a fixed-term lease early
A fixed-term lease ends on its end date without notice (41 O.S. § 111(C)). If a tenant wrongfully abandons during the term, the landlord must make reasonable efforts to re-rent; the lease ends when a new tenancy starts. If the landlord re-rents with reasonable effort but cannot get a fair rent, the tenant owes the whole rent or the difference for the rest of the term (41 O.S. § 129(B)).
Landlord's duty to re-rent: Yes. The landlord must make reasonable efforts to re-rent an abandoned unit; if it does not, or accepts the abandonment as a surrender, the lease is treated as ended by the landlord on the date it learned of the abandonment (41 O.S. § 129(B)). The Act also states a general duty to mitigate damages (41 O.S. § 105(A)).
Lease-break fees: No statutory limit on early-termination or reletting fees; the lease controls (subject to the duty to mitigate). A domestic-violence termination under § 111(F) is without penalty.
When Oklahoma law lets you leave early
Domestic violence, sexual assault or stalking (41 O.S. § 111(F) (added by SB 200, eff. Nov. 1, 2021))
A victim of domestic violence, sexual violence or stalking may end a lease without penalty by giving written notice and a protective order within 30 days of the incident.
- Proof:
- Written notice plus a protective order for an incident of domestic violence, sexual violence or stalking, given within 30 days of the incident (the landlord may waive the 30-day limit).
- What you still owe:
- The tenant may end the lease without penalty. The statute does not say how soon the lease ends after notice.
Military service (state law) (44 O.S. § 208.1)
Oklahoma applies the federal Servicemembers Civil Relief Act, including its lease-termination right, to Oklahoma National Guard members ordered to state active duty or full-time Guard duty under Title 32.
- Proof:
- Official orders to state active duty or full-time National Guard duty under 32 U.S.C. §§ 501-507.
- What you still owe:
- Same as the federal SCRA, which Oklahoma applies by state law to these Guard members.
Unit unlivable or landlord fails to repair (41 O.S. § 121(A))
If the landlord materially fails to comply with the lease or maintenance duties in a way that affects health or safety, the tenant may give written notice that the lease will end at least 30 days later unless fixed within 14 days.
- Notice:
- 30 days, in writing
- Proof:
- Written notice to the landlord describing the breach.
- What you still owe:
- The lease ends on the date in the notice (at least 30 days after the landlord receives it) unless the landlord fixes the breach within 14 days.
Unit unlivable or landlord fails to repair (41 O.S. § 121(C)(1), (D))
If the landlord willfully or negligently fails to supply heat, water, hot water, electricity, gas or another essential service, or the unit is uninhabitable or an imminent threat to health and safety and not fixed promptly, the tenant may end the lease immediately by written notice.
- Notice:
- 0 days, in writing
- Proof:
- Written notice to the landlord specifying the problem.
- What you still owe:
- The lease ends immediately on written notice.
Unit unlivable or landlord fails to repair (41 O.S. § 122)
If fire or other casualty substantially impairs use of the unit (not caused by the tenant), the tenant may move out immediately and give written notice within a week.
- Notice:
- 7 days, in writing
- Proof:
- Written notice of intent to terminate within one week after vacating.
- What you still owe:
- The lease ends on the date the tenant vacates; the landlord returns deposits and prepaid, unearned rent.
Landlord harassment or illegal entry (41 O.S. §§ 123, 124(A))
If the landlord wrongfully removes or excludes the tenant, makes an unlawful entry or an entry in an unreasonable manner, or harasses the tenant with repeated unreasonable demands for entry, the tenant may end the lease.
- Proof:
- Written notice to the landlord (unlawful entry, unreasonable entry or repeated unreasonable demands for entry); notice of intent to terminate (wrongful removal or exclusion).
- What you still owe:
- The tenant may end the lease and recover actual damages; for wrongful removal or exclusion, up to twice the average monthly rent or twice actual damages, whichever is greater, and the landlord returns recoverable deposits and prepaid, unearned rent.
Military orders, every state: the federal SCRA lets servicemembers with orders (permanent change of station or deployment of 90+ days) end a lease with written notice and a copy of the orders. How the SCRA date is counted.
